Lindsay Clancy might testify about her claims that she warned her mental health providers that she feared she might harm her three children, Cora, 5, Dawson, 3, and Callan, 8 months.
Her ex-husband, Patrick, is pursuing a $1 million wrongful death lawsuit against the medical professionals who treated her.

Howard Cooper, Patrick’s attorney, reportedly raised the possibility of calling Lindsay to testify during a court hearing on Wednesday, October 28.
He argued that she explicitly told her psychiatrist and nurse practitioner about her disturbing thoughts before the January 2023 killings.
Patrick filed the wrongful death lawsuit against psychiatrist Dr. Jennifer Tufts and nurse practitioner Rebecca Jollotta over their treatment of Lindsay in the months before the deaths of their children.
Per the lawsuit, the providers allegedly prescribed excessive psychiatric medication and failed to recognize or properly treat Lindsay’s alleged bipolar disorder. Patrick’s attorneys argued that those failures contributed to a postpartum psychotic break that preceded the killings.

Cooper said Lindsay could provide sworn testimony through a private deposition and potentially appear before a civil jury once her Fifth Amendment concerns no longer prevent her from answering questions.
“Once her 5th Amendment issues are resolved one way or the other, she will testify that she told these defendants explicitly that she had homicidal ideation [and] that she was worried about something awful happening to her kids,” Cooper said. “I can’t imagine a more explicit threat.”

Attorneys for Tufts and Jollotta have challenged the lawsuit, arguing that the medical professionals have legal immunity unless Patrick can establish that Lindsay made an explicit threat against her children or had a relevant history of violence.
Mary Azzarito, Tufts’ attorney, argued that Lindsay disclosed her troubling thoughts to her mother and ex-husband but not to her healthcare providers.
“There is no clear evidence that she told her providers,” Azzarito said. Timothy Sweetland, who represents Jollotta, also argued that the evidence did not establish that Lindsay communicated an intention or explicit threat to harm her children.

Even Lindsay’s defense attorney, Kevin Reddington, has pushed back against Cooper’s remarks, disputing the assertion that Lindsay had told her providers about homicidal thoughts.
“Lindsay Clancy never told any of her healthcare providers that she harbored homicidal ideation toward her children. She never indicated that she intended to testify … and no one acting for her ever represented that she would,” Reddington said.
